Terms of Service

Scope of Application

These GTC apply to all courses and other events (hereinafter collectively referred to as ‘events’) that Human Acting e.U. organises and for which no separate written individual contract is concluded with the participants.

Registration and Conclusion of Contract

Our offers are non-binding.

Registrations must be made in writing, via the website booking form or via e-mail. By registering, the participant makes a binding contractual offer. The contract is concluded upon receipt of the registration confirmation. Registrations will be considered in the order in which they are received. For advanced and specialised courses, there may be admission requirements and a corresponding admission procedure. No legal claim to participation in the event can be derived from the fulfilment of the admission requirements.


Registrations from persons who have not yet reached the age of 18 will only be accepted if the registration is made by a legal representative.

Event Fee and Terms of Payment

The event fees shown on the website at the time of registration apply, subject to printing errors and mistakes.

The event fee must be paid free of charge within 14 days of conclusion of the contract and before the start of the event. A later start of the event does not justify a reduction of the event fee.
In the event of late payment, Human Acting e.U. will issue one reminder free of charge. If no communication is established and no agreement reached on a payment plan, the event will be cancelled.

The event fee includes all costs for participation in the event. The event fee does not include travel, transfer and accommodation costs; these are to be borne by the participants themselves.

Multiple tickets entitle participants to attend a certain number of events (blocks of 3, 10, etc.). They cannot be cancelled or transferred. Multiple tickets are only valid for the course for which they were purchased. Their validity therefore expires at the end of the course.

The free trial lesson or the Taster block of 3 can only be used once per participant per course.

Right of Cancellation for Distance Selling

If the contract has been concluded exclusively using one or more means of distance communication, the participant may withdraw from the concluded contract or the submitted contractual declaration without giving reasons within a period of 14 days by means of a declaration of withdrawal sent within this period. A clear written notification must be sent for this purpose. To comply with the cancellation period, it is sufficient for the notification of the exercise of the right of cancellation to be sent before the expiry of the cancellation period.

If the event has already started at the time of cancellation, the event fee must still be paid aliquot to the event units that have already elapsed. If the event has already taken place in full within the period of 14 days from the conclusion of the contract, the participant will be informed upon conclusion of the contract that in this case he waives his right of cancellation in the case of distance selling.

Contractually Granted Right of Termination or Cancellation

Substitutions, Alternative Dates and Event Cancellation

If the minimum number of participants is not reached, Human Acting e.U. is entitled to cancel the event and withdraw from the contract; in this case, the participant will receive a full refund of the event fee.

The teacher named in the course announcement may, for example in the event of illness, be replaced by a substitute teacher for up to 15% of the total duration of the event.

If individual dates of an ongoing course have to be cancelled, e.g. due to the absence of teaching staff, the substitute dates stated in the course announcement will be used to make up for these dates.

Force Majeure

If a contracting party is affected by force majeure, it shall not be in default with regard to the obligations affected by force majeure. Its obligation to fulfil its contractual obligations on time shall be automatically suspended for the duration of the force majeure. This does not apply to the parties’ obligation to make contractual payments to the contractual partner. In the event of force majeure, the contracting parties must fulfil their obligations under the contract as far as possible. If the fulfilment of a significant part of a party’s contractual obligations is prevented by force majeure for an uninterrupted period of three months or for several periods of more than three months in total due to the same force majeure event, either party may terminate the contract with immediate effect; in this case, cancelled teaching units shall be invoiced and paid on a pro rata basis.

Participation in Events

The events organised by Human Acting e.U. are generally open to all interested parties. However, there is no legal entitlement to attend an event.

Human Acting e.U. is authorised to exclude people from participating in a course if there is a justified interest (e.g. in the case of illness or substance use).


By registering, each participant bindingly declares that he/she is physically healthy and mentally stable and able to cope with the relevant physical and mental demands of the event. Any restrictions or injuries must be reported to the instructor before the start of the event.


In order to ensure an undisturbed course, access to ongoing event units is only possible for participants until the start of the event. There is no entitlement to later access to and participation in the ongoing event unit.


Human Acting e.U. reserves the right to exclude persons who cause lasting disruption to the lessons from attending the event in order to ensure that the objectives of the event are achieved.

Copyright

The contents of the scripts, documents and materials provided are protected by copyright and certified by blockchain technology. They are intended exclusively for the personal use of the participants. Any further use, in particular reproduction, translation, processing and any form of commercial use as well as disclosure to other persons – even in part or in revised form – is prohibited without the consent of the author.


Individual contents are subject to Creative Commons licences. The respective provisions and freedoms apply accordingly.

Audio, Film and Photo Recordings

Participants give their express consent for audio, film and photo recordings to be made in the course of the events, which are intended for publication. Participants agree that the recordings made by them during or in connection with their attendance at the events organised by Human Acting e.U. may be analysed and published without compensation, without time and space restrictions, using any current or future technical process.

Exclusion of Liability

Human Acting e.U. is not liable for the achievement of a specific learning outcome. No liability claims can be made from the application of the knowledge acquired at Human Acting e.U..


The use of the facilities, events and offers and thus also the exercise of physical exercises is at the participant’s own risk. All participants bear full responsibility for themselves and their actions. In particular, they are responsible for all self-inflicted damage to third parties and third party property and indemnify the event manager and organiser against all liability claims.


Human Acting e.U. is not liable for loss, theft or damage to personal belongings.
Participation in excursions is at the participant’s own risk.

Data Protection

All personal data that you send us in the course of registering for one of our events/examinations will be treated confidentially by us.


Your personal data will be stored and processed by us insofar as this is necessary for the fulfilment of the contractual relationship and/or for the implementation of pre-contractual measures. The legal basis for processing is Art. 6 para. 1 lit. b GDPR. In addition, we process your data for the purpose of quality assurance. You can object to the processing of your data for the purpose of quality assurance for reasons arising from your particular situation.


Your data will only be passed on to third parties if we are legally or contractually obliged to do so.
As a data subject, you have the following rights vis-à-vis Human Acting e.U. in accordance with the GDPR: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object and the right to withdraw consent.

Legal Form

Human Acting e.U. is a sole proprietorship under Austrian law with its registered office in Vienna and its business address at Kalmanstraße 8/2/8, 1130 Vienna, registered in the company register of the Commercial Court of Vienna under FN 632231 b.

Law and Place of Jurisdiction

This agreement is subject to Austrian substantive law. The exclusive place of jurisdiction for all disputes arising from and in connection with these GTC is – unless otherwise provided for in Section 14 of the Austrian Consumer Protection Act (KSchG) – the court with subject-matter jurisdiction for Vienna, 13th district.
